This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

For the purpose of these Terms of Use, wherever the context so require "You" shall mean any natural or legal person who has agreed to become a member of the Website https://www.maathetouchofindia.com by providing Registration Data while registering on the Website as Registered User of MAA – The Touch of India.

The customer by accessing / using http://www.maathetouchofindia.com as a registered user agrees to be bound by the terms and conditions, policies of our website. Any customer willing to use our website may create an account by providing true, accurate and complete information as to name, address, email, phone number, and thus avail the services. Please note that we rely on the information you have provided to us at the time of creating an account for verifying your details and further for delivery purposes and communication of any attractive offers from time to time.

MAA – The Touch of India reserves the right to change, amend, modify or update the policies, terms and conditions from time to time, without any notice and the revised terms and conditions would be available on website, hence customers are requested to read the same carefully.

You agree that the Company may appoint any third party service provider, including but not restricted to one or more of the Company's affiliate to provide backend operations and support as instructed by the Company from time to time including but not limited to collection, processing and remittance of the Transaction Price using the existing authorized banking infrastructure to provide enabling support facility for collection and remittance of payment including but not limited to the Logistics Partner.

  1. User Account, Password, and Security:

If You use the Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or not in accordance with this Terms of Use, We shall have the right to indefinitely suspend or terminate or block Your access on the Platform.

If there is reason to believe that there is likely to be a breach of security or misuse of Your account, We may request You to change the password or we may suspend Your account without any liability to MAA – The Touch of India, for such period of time as we deem appropriate in the circumstances. We shall not be liable for any loss or damage arising from Your failure to comply with this provision.

In the event of a device being associated with multiple logins or sign ups, as a measure to enhance customer's security and privacy as well as safeguarding your sensitive information for any potential risks, MAA sometimes consider moderating users and their association with devices while using the MAA app or website.

Your mobile phone number or email is treated as Your primary identifier on the Platform. It is your responsibility to ensure that Your mobile phone number and your email address is up to date on the Platform at all times. You agree to notify Us promptly if your mobile phone number or e-mail address changes by updating the same on the Platform . You agree that MAA – The Touch of India shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under your Account in cases, including, where You have failed to update your revised mobile phone number and/or e-mail address on the Platform. You agree to immediately notify MAA – The Touch of India of any unauthorized use/breach of your password or account.

If You share or allow others to have access to Your account on the Platform ("Account"), by creating separate profiles under Your Account, or otherwise, they will be able to view and access Your Account information, You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences therefrom.

  1. Intellectual property Rights

The domain name "https://www.maathetouchofindia.com" is controlled and operated by MAA – The Touch of India. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by MAA – The Touch of India. Material on "MAA – The Touch of India" web site owned, operated, licensed or controlled by MAA – The Touch of India is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and you must not assist any other person to do so. Without the prior written consent of the Owner/Proprietor, modification of the materials, use of the materials on any other web site or networked computer environment or use of the materials for any purpose other than personal, non-commercial use, is a violation of the copyrights, trademarks and other proprietary rights is prohibited. Any use for which you receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

The Customers are advised to shop and use the products only through our registered domain https://www.maathetouchofindia.com, as we don’t sell our products through any other website or online portal within India. We shall not be liable in any way to any person for buying our products or similar products under the name "MAA – The Touch of India" from any other online store.

  1. Payments

The prices stated for the products are inclusive of GST and shipping charges. The customer can make the payment by either ways – (i) online payment using net banking, debit/credit cards through our payment gateway partners RazorPay. * For this purpose we may enter into agreements with third party payment gateway aggregators and financial institutions authorized by the Reserve Bank of India for collection, refund and remittance and to facilitate payment or (ii) a direct payment to us via bank transfer/NEFT. Any merchant charge or additional payment gateway charges shall be borne by the customer who will be accessing the payment gateway.

(*Payment gateway partners may subject to change in future and will be notified accordingly.)

While availing any of the payment method/s available on the Platform, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:

  • Lack of authorization for any transaction/s, or
  • Exceeding the preset limit mutually agreed by You and between 'Bank/s', or
  • Any payment issues arising out of the transaction, or
  • Decline of transaction for any other reason/s

All payments made against the purchases/services on Platform by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Our platform will not facilitate transaction with respect to any other form of currency with respect to the purchases made on the Platform.

Before shipping / delivering your order to you, Seller / Delivery Partner may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to Our Users.

  1. Limitation of Liability

In no event shall "MAA – The Touch of India" be liable for any special, incidental, indirect or consequential damages of any kind in connection with this agreement, even if "MAA – The Touch of India" has been informed in advance of the possibility of such damages.

  1. Refunds and Exchange Policy

We offer refunds and exchanges on products for the following cases:

Genuine Quality Issues: If you receive a saree or any other product you have purchased from our platform with genuine quality problems, please contact our customer support team within 7 days of receiving the product. We may request you to provide additional photographs or other forms of verification to process your return. We will initiate the refund/exchange process once we have received the product and investigated the issue.

Damaged or Wrong/Missing Product: If your saree or any other product you have purchased from our platform arrives damaged or if you receive the wrong item, please contact us within 7 days of receiving the product. We will initiate the refund process or send you the correct item at no additional shipping cost, based on your preference. The refund amount, if any to be credited to the customer will be done within a period of 14 working days.

No refunds and exchanges are available on products for the following cases:

RTO: Customers are requested to provide a complete shipping address with active phone number. Post failed delivery attempts by our shipping agency the package will be returned to our warehouse. If any reshipping requests are raised, customers will have to pay additional shipping charges at actuals.

Colour Mismatch: We take utmost care while photographing images to match the true color of the saree or any other product you have purchased from our platform. However, there might be slight colour variations due to differences in the display of the screen. Kindly note colour variation or colour mismatch will not be considered as a valid reason to process a refund.

  1. Conditions for Returns and Exchanges:
  • Any requests for returns must be raised with the customer care team within 7 days of receiving the product. No return and exchange request would be accepted if the return/exchange request is raised after 7 days of receiving the shipment. For the purpose of calculation of 7 days from the date of shipment, we shall only rely on our records.
  • A full unboxing/opening video of the parcel is mandatory for claiming a refund or exchange. The damage or the issue has to be captured in the video for ease of claiming refunds. Any claim for returns or exchange will not be processed if such an unboxing/opening video is not provided by you.
  • All products being returned or exchanged must be unused, unworn, and in their original condition with tags attached.
  • Please ensure that the product is returned in its original packaging to prevent any damage during transit. Any further damages caused to the product owing to any lapse in re-packaging by you shall be borne by you.
  • We do not accept returns or exchanges on products that have been customized or altered to your specifications like adding fall and edging. We do not accept the return/ Exchange or cancellation of Dress materials /Fabrics.
  • Orders placed for Gift vouchers are not eligible for return/cancellation.
  • The decision by MAA – The Touch of India regarding the condition of the product will be final and binding. The refund process will commence only after our quality assurance team has conducted a thorough examination of the returned item and has verified the reason provided by the customer for the return or exchange.
  • If you wish to exchange the product for a higher-priced item, the deficit amount shall be paid by you prior to shipment of the exchanged Product.
  1. Process for initiating a return

To initiate a return, we kindly request you to contact our dedicated customer support team at maa.thetouchofindia@gmail.com within 7 days of receiving the product. When reaching out to us, please provide your order number, a detailed explanation of the issue, along with clear photographs and an unboxing video. Our expert team is ready to assist you and will guide you through the entire process.  

  • Upon receiving your query, our team will assess your situation on a case-to-case basis. And then present you with the available options.
  • Upon the successful verification of the returned product’s quality, your refund or exchange request will be approved.
  • In the event of an exchange, our team will provide comprehensive guidance regarding the exchange process. This includes facilitating the exchange for the same product or assisting you in selecting an alternative product of your choice as available.
  • In the event of a refund, we endeavour to process refunds promptly, typically within 14 business days. The refund will be credited through the original payment method used during the purchase, ensuring a seamless transaction experience for you.
  • In rare cases where the quality check of the product does not meet our stringent standards, the item will be reshipped to you promptly and at no additional cost. Please note that in such instances, there won't be an option for a refund or exchange.
  1. E-Platform for Communication:

You agree, understand and acknowledge that MAA – The Touch of India is an online platform that enables you to purchase products listed on the Platform at the price indicated therein at any time.

  1. Out of inventory communication:

You understand that, in the event selected products in your cart is out of the inventory, you can send an email request for the product availability to our email id support@maathetouchofindia.com with a subject line “Query regarding Product availability”. Though we can try our best to make sure we collect the same product for you, but there is always a possibility we might fail to get you the same product. In that situation we may update you with the alternate product choices.

  1. Jurisdiction

In case of any dispute, the courts in the city of Kolkata will have the exclusive jurisdiction to entertain any litigation pertaining to the present agreement/contract.
